More than 200 music artists, including renowned figures like Nicki Minaj, Katy Perry, Billie Eilish, Stevie Wonder, J Balvin, and Jon Bon Jovi, have collectively endorsed an open letter cautioning against the “exploitative use of AI” within the music sector.

The joint statement, released by the group of artists on Monday, recognizes the significant potential of AI in advancing human creativity. However, it also serves as a warning against the possibility of major corporations utilizing artists’ original content to train AI models with the ultimate goal of replacing human musicians entirely.

The letter emphasizes the necessity to safeguard against the predatory exploitation of AI, which could lead to the theft of artists’ voices and likenesses, infringement of creators’ rights, and disruption of the music industry ecosystem.

Furthermore, it calls upon technology firms, AI developers, and digital music services to commit to refraining from developing or employing AI-powered tools that undermine the work of songwriters and artists or hinder their ability to receive fair compensation for their artistic endeavors.

Rationale Behind Artists’ AI Concerns

While the open letter delivers a strong message, the enforcement of compliance by companies poses challenges, according to Michael Huppe, the president and CEO of SoundExchange. Huppe, who also serves as a music law professor at Georgetown University, highlights the complexities involved in persuading companies to adhere to these demands.

In a blog post dated March 29, OpenAI, the entity behind ChatGPT, unveiled a new AI tool capable of creating a lifelike replica of a person’s voice based on a mere 15-second audio snippet. OpenAI acknowledged the risks associated with voice cloning technology and clarified that the tool has not been made public as of yet.

The company stressed the importance of implementing voice authentication measures for any widespread deployment of synthetic voice technology. These measures would ensure that the original speaker consents to their voice being used and establish safeguards to prevent the replication of voices resembling prominent individuals.

Despite the protections afforded by U.S. federal copyright laws against direct replication of artists’ work, applying these laws to AI-generated content that imitates an artist’s voice or style without replicating their lyrics or music poses a challenge.

Huppe advocates for updates to existing laws to keep pace with the rapid advancements in AI technology and prevent its irresponsible use. He underscores that an artist’s voice is integral to their brand, and unauthorized usage of their voice or likeness constitutes a form of brand theft for commercial gain.

In response to these concerns, Tennessee, a prominent music and entertainment hub, passed the Ensuring Likeness Voice and Image Security (ELVIS) Act, making it the first state to safeguard musicians from AI voice cloning technology. This legislation, effective from July 1, extends the state’s protections for artists’ name, image, and likeness to encompass their voice as well.

Harnessing AI’s Potential in Music Industry Innovation

Despite the apprehensions surrounding AI, Huppe acknowledges that AI innovation can bring positive advancements to the music industry if used responsibly. He suggests that obtaining artists’ consent for using their voice in AI-generated music, ensuring fair compensation, and providing due credit can pave the way for collaborative opportunities.

Huppe asserts that with consent, acknowledgment, and remuneration, many artists and creators would be willing to engage in collaborations with AI. He believes that a collaborative approach, underpinned by these principles, can lead to mutually beneficial outcomes.
