Rules governing the use of artificial intelligence should encourage creativity, according to Kent Walker, Google’s chief legal officer. Walker stressed the significance of promoting innovation, aligning with the appeals from various businesses and tech organizations as the European Union works towards finalizing AI regulations by the upcoming month.

As EU countries and legislators collaborate to refine a draft proposal presented by the European Commission, the focus lies on achieving a consensus by December 6. One of the key topics under deliberation is the handling of foundational models such as OpenAI’s ChatGPT. These models, driven by extensive datasets, have the ability to adapt and excel in various tasks by continuously learning from new data.

Walker urged Europe to prioritize the development of high-quality AI regulations rather than rushing to be the first to implement them. He highlighted the importance of adopting a balanced approach that promotes technological progress while ensuring accountability for any violations of public trust. Stressing the significance of effective AI regulation, he emphasized the need for regulations that strike a harmonious balance between fostering innovation and providing oversight.

Emphasizing the crucial need for nuanced decision-making, Walker identified the essential trade-offs between security and transparency, data accessibility and privacy, as well as explainability and accuracy. He called for the establishment of rules that are proportionate and risk-based, enhancing the current regulatory frameworks to offer businesses the certainty needed to continue investing in AI advancements.

Recently, DigitalEurope and 32 European digital associations cautioned the EU against imposing excessive regulations on foundational models, echoing the sentiment that a cautious equilibrium must be preserved to effectively support AI innovation.
